that the measure of the War Department

rights in the Military Reserve Land now leased

as gerden lots is the difference in value

between the land as subject to the right of the

War Department to control the erection of

buildings and its value when freed from the

right i.e. the difference between the value of

the land in the open market (for building) and

as garden lots. In the case of the land over

which militery rights are fully exercised for

rifle ranges or field exercises, the value is

the difference between the value of the land in

the open market (for building) and as agricul-

tural land subject to the War Department rights

of user aforesaid. The Surveyor appointed is

to be instructed to make his valuation on this

basis.

The War Department will, therefore, be

debited with the garden lot or agricultural

value, subject to the War Department rights of

user of the land which they require at Gun Club

Hill, and will be credited with the difference

between the garden lot or agricultural (subject
